The "In re Rachel L." decision handed down by the Court of Appeal of
the State of California, Second Appellate District, in Los Angeles
County, on Febuary 28, 2008, has become too controversial to ignore.

I am working closely with Debbie Schwarzer, a legal advisor with HSC,
the large inclusive California Homeschool Association, to gather
contacts of parties that all have a stake in this decision, mostly the
California private ISPs.
Californians should note that the CA DOE has NOT taken down the PSA
form from their website...

The family had been in court before for child abuse charges. The
private ISP they had enrolled in was one run by a fellow who has been
a thorn in our side for decades, trying to pose as his own version of
HSLDA. He posed his site as a California Association, but no one in
their right mind paid him any attention. He has tried to strike down
the right for Californians to homeschool under the Private School
Option for years! My guess is that he somehow instigated this, though
he is posing to be on the side of the family.
What saner heads are trying to do is to keep this decision from
affecting anyone else. Distance learning programs and umbrella schools
are quite popular here in California, especially for those who don't
want to be under public school programs or to homeschool independently.
Fortunately, we have a very pro-homeschooling Public Instruction
Superintendent, Jack O'Connell. I don't believe he'll go off
half-cocked. There are about 100,000 homeschooled kids in California,
and they couldn't open up enough classrooms fast enough to accommodate
us all.
Those in California who homeschool under a private ISP may want to
take the extra precaution of asking for a copy of that program's PSA,
just to make sure they have one. All private schools with more than 5
students are listed here:

If yours is NOT there, and it isn't your own homeschool private school
with 5 or fewer kids, and you are reasonably sure you aren't the only
family in its program, then you do have the right to ask them to fax
you a copy of their PSA. If they can't or won't let you see it, then
file the PSA for yourself right away. Theirs may not be a legitimate
private school ISP in California.
